Besides being a cool, historic photo, I love how this photo highlights how people in Redwood City have been raising hell for decades. :)

And it highlights how corporations/big business have long seen RWC as an arena for their assault on the environment, whether it be Cargill trying to fill in the bay, Sundt/Layton and HOK building a jail on a toxic site, or the Pauls Corporation driving out sustainable/affordable communities to build high-rise condos in the path of sea level rise.

People in RWC government and their friends say that protests and activism of the type that Occupiers practice is “not how we do things in Redwood City.” To those people, I point to Ann Sims and say: “Oh, really. You sure about that?”

Leslie of Save Pete’s Harbor (SPH) speaks to the California State Lands Commission (SLC) at their 24 January 2013 special meeting. Lt. Governor Gavin Newsom was present in his capacity as an officer of the SLC.

In this video, Leslie explains why she has come to the SLC: because all local government bodies and agencies and elected officials whom we at SPH have reached out to have either refused or neglected to help the community of nearly two hundred boaters and RV residents at Pete’s Harbor (in Redwood City, California) who were evicted on 15 January 2013 by Paula Uccelli, a prominent local campaign fund donor and long-time friend of city, county, and state government.

SPH is a group of concerned citizens whose goal is to preserve the state-owned, outer portion of Pete’s Harbor in Redwood City, California as an environmentally friendly marina open to the boating public.

The SLC manages the submerged state lands at the outer harbor. Pete Uccelli placed a marina on these submerged state lands without the state’s permission and he was ultimately given clear title to land to which the state had some public trust right, title, or interest that was subject to uncertainty and dispute. SPH hopes that the SLC understands that Mr. Uccelli was only given a unique deal on the leases of these submerged state lands because Mr. Uccelli was providing a major service to the boating public by providing maximum feasible public access to these submerged state lands in Smith Slough.

Otherwise, Pete’s Harbor could not have happened at all. The SLC needs to understand that at a minimum, they must make sure that boater access isn’t decreased and that these submerged lands must be kept for a public access marina in keeping with the Commission’s own policy statement on the Public Trust Doctrine.

SPH is dedicated to ensuring that any development at Pete’s Harbor, such as the one currently proposed, responsibly mitigates all potential environmental impacts under CEQA and is fully compatible with a public (commercial) marina. Such impacts include the disruption of boating communities which require the building of replacement units in Redwood City to mitigate impacts to all recreational boaters, including liveaboards and cruisers.

Despite initial reports to the contrary, FBI agents did not read Boston Bombing suspect Dzhokhar Tsarnaev his Miranda rights immediately after he was taken into custody. Instead, they invoked what is known as the “public safety exception” to delay reading those rights to the alleged bomber. Here’s what you need to know about this narrow exception to the Miranda rule:

The Public Safety Exemption Is Real
The Supreme Court first held that there is a public safety exemption to Miranda in a 1984 case known as New York v. Quarles. In Quarles a woman told police that a man with a gun raped her, and that he’d run into a nearby grocery store. Police quickly found the suspect within the store, arrested him after a brief chase, handcuffed him, and discovered that he was wearing an empty shoulder holster. Before reading him his rights, an officer asked him where the gun was, and the suspect told the cop where to find it. After retrieving the gun, police then read the suspect his Miranda rights.

Although the Constitution generally forbids law enforcement from interrogating suspects in custody without first reading them their rights, the Court held that a narrow “public safety exemption” permitted the limited questioning that occurred in Quarles. As the Court explained, “procedural safeguards which deter a suspect from responding were deemed acceptable in Miranda in order to protect the Fifth Amendment privilege; when the primary social cost of those added protections is the possibility of fewer convictions, the Miranda majority was willing to bear that cost. Here, had Miranda warnings deterred Quarles from responding to Officer Kraft’s question about the whereabouts of the gun, the cost would have been something more than merely the failure to obtain evidence useful in convicting Quarles. Officer Kraft needed an answer to his question not simply to make his case against Quarles but to insure that further danger to the public did not result from the concealment of the gun in a public area.”

As the Court emphasized, this exemption is “narrow.” It permits police to ask a limited range of questions for the purpose of removing any imminent threats. It does not permit wide-ranging questions intended to build a case against the suspect.

FBI Guidelines Apply The Public Safety Exemption Aggressively In Terrorism Cases
A 2011 FBI memorandum says agents may delay reading Miranda rights to a suspect in “exceptional cases” when the FBI “conclude[s] that continued unwarned interrogation is necessary to collect valuable and timely intelligence not related to any immediate threat.” According to a DOJ spokesperson, this guidance exists because “the threat posed by terrorist organizations and the nature of their attacks—which can include multiple accomplices and interconnected plots—creates fundamentally different public safety concerns than traditional criminal cases.” Needless to say, this guidance is controversial, as it extends the public safety exemption beyond truly imminent threats to encompass more distant — but also potentially more deadly — future threats.

In any event, it is worth emphasizing again that the public safety exemption does not allow broad ranging questions for the purpose of building a criminal case. Even if the Obama Administration is correct that the exemption can be applied more broadly to suspected terrorists, law enforcement may only invoke the exemption to ask “questions necessary to secure their own safety or the safety of the public.”

The FBI Cannot Indefinitely Delay Reading Tsarnaev His Miranda Rights
Because the public safety exemption is rooted in the “need for answers to questions in a situation posing a threat to the public safety,” it is only temporary. Eventually, it may become clear that no such threats exist (or at least any that Tsarnaev is capable of providing information about). At that point, he must be read his Miranda rights even under the most lax plausible understanding of the exemption. Additionally, if law enforcement wishes to ask Tsarnaev questions geared towards gathering evidence to use against him at trial, they must read him his Miranda rights.

It’s important that when people do #activism, that it not simply be personal stuff: #environmentalism especially has gone down the dead end of lifestylism, where people think that changing their own life is sufficient.

Just today I read an article that said, about water, “First of all, turn off the water when you don’t need it. It’s that simple. I don’t want to sound too preachy, but, according to UNICEF and the World Health Organization, lack of access to clean drinking water kills about 4,500 children per day. The water won’t magically travel from our taps to someone in need, but creating a mind-set of conservation will certainly help. There is absolutely no purpose served by letting water you are not using run down the drain.”

This is just absurd. Yes, lack of access to clean water kills 4500 children per day, but it’s not because of my own water usage. 90 percent of the water used by humans is used by agriculture and industry. So all these environmental pleas for “simple living” are tremendous misdirection: these children aren’t dying because I brushed my teeth: they’re dying because agriculture and industry are stealing the water.

Just yesterday I read that Turkey is sacrificing all nature reserves to put in dams. This is not so people can have showers. It’s for agriculture and industry.

I live pretty simply, but that’s because I’m a cheapskate. I turn off the water while I brush my teeth, too. Big fucking deal. That is not a political act.

There are no personal solutions to social problems. None.
